InterServer Doesn't Care About DMCA

Mods, Please put this in correct section.
There is a website hosted on a server provided by interserver.net. This website is copying lot of data, which is copyrighted information of my client.
I have filed DMCA against the guy who is copying with interserver.net, but they have not responded for 5 days.
The guy running the site has given fake contact information and whois is private. The hosting company is also with some fake contact information.
And, the server provider doesn't respond.

so for over 3 weeks now pc-core.net had some problems with their servers and my accounts were just lost and no one answers my support tickets they just erase them, they disabled my account to support so i can only submit support tickets and click the link on the email.
they told me to email cshelpdesk.com to get my account moved to a new server and cshelpdesk is just telling me im SOL. they dont have access to the server i was at and basically to F off.
is there anything i can do? im basically just being ignored and they dont even have a number to them.

I had bought a $39 atom server from Interserver for a personal project that lasted several months and just wanted to give them a "great job" for the great service/support I got from them, even considering it was an unmanaged server for $39/mo.

I realize this is an old thread but felt I should put my two cents in as a "host-care" customer.
I quoted out host-care due to the fact I don't actually purchase my hosting from them. They appear to be a provider for other web-hosting companies as I bought my hosting from a seperate vendor. I have also had my account suspended once before due to a problem in my scripting where a while loop continued running.
After 24 hours my site was back up and I had found the error and corrected it. The host-care.com website is the support site for my hosting company and if my hosting company is unable to solve the problem I am able to contact host-care directly.
To me it sounds like the original poster didn't read the TOS before jumping right in and didn't properly test his site before uploading.
All in all I've been with host-care about 2 years now and am happy with them.

On Thursday, I posted a review (on anther host review site)* of H9 which was not very complimentary to say the least. To my surprise on Friday morning I had an email from Ben Gabler the Operations Manager with H9 and his email expressed some concerns about what I had written. He asked if he could call me to discuss my problems and to cut a long story short, we spent 45 minutes on the phone on Friday afternoon and he gave me the impression that he is a guy who is really concerned that all H9 customers get what they want in terms of both price and service.
Ben's call came at a very opportune moment as on Friday morning I had spent several hours with my new hosting company trying to get tech support from a supposedly 24/7 tech support team - it just didn't happen - and 48 hours later, it still hasn't!
He gave me several good reasons to have another go with H9 - none of them monetary! One of the things we discussed at length was tech support. Ben explained to me why they were trying to get customers to use tickets rather than the telephone, the reasons are to long to go into here but I do now believe that for 99% of everyday problems it is actually better to use a ticket system rather than the phone. I am surprised at my own reaction here because I far prefer to pick the phone up than tap away at the keyboard, but as Ben pointed out, with a ticket system, you have a full trail of what was said by by yourself and the person dealing with the ticket - ain't no arguing with that!
I have to say that I was very impressed that he looks at the reviews posted here and he was concerned enough about my complaint to actually do something about it personally.
So, I decided to give H9 another try. During the early hours of Saturday morning, H9 transferred several accounts from the other web hosting company to my H9 account, For the most part the transfers went without a hitch and the one problem there was was sorted within 10 minutes of my seeing and reporting it to H9.
So from a good start to a patchy week, I have come back to being a very satisfied customer.
If no one objects, I'll post regular updates here.

I have emailed leaseweb's abuse department with a link to one of the biggest french warez forums, they asked me to provide direct links to illegal contents and proof that I own it.
I emailed them links to windows, photoshop, movies, mp3, video games and stated that I don't own those but its clearly illegal. Here is the answer I got from them:
"I am only going to take action if I receive a complaint from the legit
owner."

experience with InterServer, may I know how long it took for your servers to be set up?
I had order a server, received an order confirmation email. Then I paid through PayPal and that was the end of it. No payment confirmation.
My order status in the member page is still "pending".
Is this normal? I've only order about slightly more than a day ago.

Summary
I just wanted to create a quick post here letting everyone know that we've been with InterServer.net for about 7 months now and everything has been wonderful. The datacenter is beautiful, the support team is brilliant, uptime is fantastic, and the prices are quite a steal.
Datacenter
I personally drove our server to InterServer up in Secaucus back in May '07. It was quite a trip as they are so close to New York and we are located in South Jersey. When I arrived, I rolled down my window and asked the gentlemen who was walking inside if I was at the right place. He replied "Yes this is Interserver are you Richard?". To my surprise, I hadn't been there but a few seconds and was already speaking to the owner (whom I'd been communicating with through tickets prior to coming up). He quickly brought me into their NEW datacenter so that I could put our beast of a server on the rack and get it back online. As soon as I had it up, he had a KVM cart rolled over and was already working on getting things setup. The server was back online in less than 15 minutes of me walking in the door. While he worked, I observed the new facility. It's large, clean, and cool -- perfect combination. Because I had to get going, I couldn't stay for a tour of their other datacenter but I'm sure that it was equally as nice.
Support Team
On a number of occasions I have needed help getting hardware worked on as well as some software tweaks. John & team have always been very quick to resolve my tickets. They are very professional and fast regardless of whether I'm dealing with them through their helpdesk or the telephone. Whenever I call they are very nice and helpful and I really feel that they care about their customers.
Uptime
In all the time I've been with them their network has been just about FLAWLESS. There has been maybe one outage which didn't last long at all, which was a huge change of pace from my previous provider (Burst.net) who would have frequent and long-lasting outages.
Aside from that one minor hiccup in the 7 month period, the network is always EXTREMELY fast. I love the way their network is setup and it has very intelligent routing.
Whenever there is the slightest network congestion, their routers re-route traffic so that everything stays smooth. Because they share a lot of premium New York bandwidth, I feel that InterServer is a GREAT alternative to expensive colo providers like Voxel where you could spend a small fortune because they're in New York.
Bottom line: If you're looking for NY/NJ colocation or even just a dedicated server in that area, I highly recommend InterServer.

colocation, Liquidweb or InterServer?
We're located in NJ so InterServer would only be 2 hours away. I don't have any previous experience with InterServer so I don't know the reputation in terms of network and support. I have been with LiquidWeb and know their network and support to be extremely good.
Between the two, who would you choose and why?
For the sake of argument, the price is the same and you are making the decision based off being in my location, not your own.

I setup Apache 2.2.21 on a Win7 (32-Bit) Desktop with SVN 1.5.6 and WebSVN 2.3.3.
My problem lies with navigating to view the repository thru websvn.
I only want my users to be able to access the websvn thru this url, 'myservername/websvn' but they are able to access it thru other variations of the url, eg.'myservername/WebSvn', 'myservername/wEbSvN', 'myservername/WebSVN'.
I am using CheckCaseOnly but it still does not solve the problem. Here's the code of my config file for websvn,

First off thank you WHT for providing these forums and please forgive me for my first post being a huge rant!
We have contacted ThePlanet multiple times with DMCA requests to have a website remove illegal copies of our software from their website. The website is (*****.com *removed link*), and ThePlanet hosts them.
This issue has been ongoing for over 10 days, our original DMCA from them was ignored.
We resent another on Tue June 2, 2009, that one was responded to. Either no one from ThePlanet bothered to visit the warez website or they encourage warez on their networks because the website is still up; they initially removed links to our software but added new ones hours later.
We contacted ThePlanet again hours later with our email again to be disregarded. We sent another reply last Friday, ThePlanet responded back that our email was not in proper DMCA format; but do not bother to see the entire website is nothing but warez. Do these guys just not care that warez is on their network? I didn't realize the economy has gotten so bad they now cater to warez websites.
Visit the website and see that is has full ISO copies of Windows and other software, has full dvdrip movies and copies of games, as well as crack patches and keygenerators.
Why is it that ThePlanet allows these websites to operate and that their AUP is a total joke? Obviously if you want to distribute warez ThePlanet seems like the best place to do it.
We also hosted our websites on ThePlanet but intend to cancel service with them due to this issue. I encourage anyone that is a software developer and uses ThePlanet to also dump their service.

I contacted HostGator a few days ago in regards to a website being hosted on their network. The blog post had a link to a decompiler that would decompile applications written by a certain program. The responses I received from Richard F. (Network Security Administrator) of HostGator was not what I expected.
At first, Richard F. wants to see the EULA of the software that the decompiler is made for. So, I send him the URL and even quote the EULA. It states, "Neither you nor any third party may modify, adapt, decompile or reverse engineer the Games." In addition, I pointed Richard to the author's blog where the author is not happy about the decompiler as people can use it to steal and ripoff games and applications written with this software. Richard F. then defends the decompiler by stating the following:
"Well, this is a complicated situation. Having the decompiler available is in itself not any violation of the EULA. However, if someone uses it then it's a violation of that EULA. Making the decompiler available solely as a source of information is not in any way infractionary, this has been held up in court cases with companies such as Microsoft."
It seems he is trying to use some alleged loophole of having it available for "information purposes only" does not make it illegal or a violation of HostGators TOS/AUP. I then notify him that it is also a DMCA violation as the only reason for reverse engineering per the DMCA is if the software is no longer available nor the author available. Neither of these conditions are met as the software that is decompiled is still being made and the community that uses the software is active. Richard F. then makes the following illogical analogy:
"Yes it could be seen as a violation of the DMCA. However, again, as an informational source, it is not in any violation. If we wanted to go on a tangent and say that this tool was written in, say C#, we could then hold Microsoft liable for creating both the C# language and an IDE to allow someone to write this tool. But they're not liable for what is created with or done with their tools, they merely provide them. This is where we are in this situation. Simply providing the information is not illegal."
Firstly, no one ever went on any tangent. Next, his analogy makes no sense. The fact of the matter is that the website being hosted on HostGator's network is distributing a decompiler that circumvents security measures in a program. People that use this particular software to compile their games and applications can have their source code revealed by a person simply running this decompiler.
I guess Richard F. is not used to dealing with techniaclly adept people. Therefore, he pulls a bunch of technical BS out of his gator butt and expects me to believe it.
I have forwarded this issue to The Planet as well as to the author that made the software being decompiled. I have notified him of HostGator condoning the use and distribution of this decompiler. I think it's pretty sad when a hosting company starts to defend immoral and unethical activities. And to think, this joker is actually has the position of "Network Security Administrator." He sounds like some kid barely out of high school computer science class.

my host freaked up when getting a letter from a company about DMCA, and quickly shut my site down.
Does anyone know of a dedicated server hoster who does not jump the gun and shut down sites from a little Cease and Desist letter for around 299 EUR a month?
The site gets roughly in the thousands of hits per day.
(Off-shore hosting is fine too)

I have sent a DMCA notice to softlayer because I saw warez forum thats abusing USA laws and they are giving away lots of hacked rapidshare accounts to its users. So I have made my complaint but I didnt said what infringed my copyrights. And softlayer can see the warez site and decide them selves.
So this what I got in reply after 2 weeks-

We recently discovered another host had stole parts of our page and use it as theirs. Right now we are currently looking to contact it's service provider to submit the DMCA complain. However we have no success of contacting their provider XO. So now we are looking to contact their actual provider (reseller of XO) but we were unsuccessful in finding such info. If anybody here could give us a hand?

How well does ThePlanet.com handle DMCA complaints?
Recently got shafted by a client for over $30K (3 months of work plus our own out of pocket expenses). To make matters worse, this crook took the PHP source code which my company offers as a hosted solution and installed it on a dedicated server at Theplanet.com.
I have sent DMCA take down notices to theplanet, following their procedure (which is the standard legal procedure) but they have not done anything to the perpetrator. He has managed to spring up 2 websites already, and is no doubt planning to launch more.
Not sure if anyone else has been in this type of situation but I need to get something done about this. I have no doubt in my mind that even if theplanet did shut his sites down, or at least wiped the infringing software from the disks, he would jump over to another host and do the same thing again. My company doesn't have time to waste chasing him around, however the software he has contains a lot of proprietary code that we created and was never intended to be public.
So far both of the domains that he is using have Network Solutions as the registrar. Does Netsol assist with this kind of thing? Hopefully someone with similar experience can chime in with some advice.

I just had the pleasure of having my entire host containing multiple sites,being suspended by Godaddy because someone sent them a notice of infringement. Even though I had resolved the issue with the copyright holder 8 hours before Godaddy suspend the host.
Which brings me to my question, anyone know of a host that's reliable, well priced and not effected by the DMCA?

We run into DMCA problems (Windows Media Streaming) 3-4 times a year and most of these requests come for content that are not even governed by US laws.We currently have Ecatel and they have been good with DMCA but their quality has been a major drawback (Stream buffering big time, even for a dedicated server)
We are looking for a Windows server 2003 streaming server with at least 100Mbps dedicated unmetered connection (will upgrade to 500 or even 1Gbps dedicated if the quality is reasonable).

As posted in a previous thread I noted how I have been hosting with GeekStorage. After a little bit of investigation I found that a total of 593 (possibly more) website where being hosted on the same server as mine. I'm not sure if this is overselling but because I'm new to all this but I'm pretty sure it is.
Now, I'm looking on switching from GeekStorage to someone who doesn't oversell. I would be fine with 10-20GB of storage and >150GB bandwidth. Budget is 5-10$ a month.

I am using Windows 2003 Enterprise Edition SP1 and i have recently set the computer up to 4GB RAM. I notice a problem occur error :
When I start the computer, Bios detected all 4GB Ram. However, i have checked Total physical memory in General (My Computer-> Properties) doesnot detect all 4GB Ram. it only detect 3GB Ram.
I have checked that this OS support up to 32GB . Why it doesn't detect all 4GB ?
What happen to it?
Mainboard : Intel chipset 915GL
I did following the instruction in internet (exactly is Microsoft) is /PAE in boot.ini file. But, it doesnt work.

The email of my client doesnt receive certain emails from certain accounts, including my yahoo.com.ph account. After several tries I received this error instead.

After migrating from the old ensim to the new "X", everything is working fine, except for the webalizer, I activated webalizer in one domain a few days ago.. and everyday Im trying to see the webalizer information, and it is always displaying this message:
Could not retrieve the requested site report because the Web server logs have not yet been generated. These are generated once a day. Please check again later.
I also tried forcing the log rotating for that site, but the problem still there.
Server is RHES 4 with EnsimPro X, log generation and webalizer is activated for the domain.

I configured monit to send me email alerts when apache is using too many resources but I cannot receive email alerts. I use Qmail.
As for syslog, there is this message:

I tried to add for server name the name used in MX record but with the same result.

im using centos and a perl script doesnt seem to work on my system.
it gives an error on this line.
use LWP::UserAgent;
$ua = LWP::UserAgent->new;
$ua->agent("MyApp/0.1 ");
BEGIN failed--compilation aborted at line 8.
is it a problem with my perl or is it an error with the script?

I'm on windows vista. I've got an SDSL line into the house with a dedicated IP 62.etc. I've then got a Prestige 791R and all PC's plugged in to that. I've also got a wireless router for my Wii set up.
Basically I've set up this DHCP thingy to start at 192.etc.3 and the Wireless router is at 192.etc.1 and the Prestige is at 192.etc.2 my pc is at 192.etc.9
This is about where my knowledge stops unfortunately.
I have installed apache as the most basic default install I think you can and it seems to be working absolutely fine. I'm assuming I could also install PHP and MySQL etc and wouldn't have too much of a problem, however, my friend cannot seem to access the environment from the WAN IP and when I type in my WAN IP I get the prestige router's control panel.
I read somewhere that I needed to forward port 80, now I can 'open' ports in the prestige control panel but I did try opening port 80 in the control panel and pointing it to my LAN IP (92.etc.9) but it didn't seem to work.
I'm at a bit of a loss so if anyone could point me in the right direction I would be most grateful, just to clarify:
//localhost loads the html file 100%
//192.etc.9 loads the html file 100%
//62.WANIP internally loads my prestige routers control panel
//62.WANIP externally does not load a page (cannot be found)
If you need any more info just let me know and I'll get it.
