Hetzner Bandwidth Policy - Misleading Or Interpreted Incorrectly

We brought a RootServer with Hetzner after being recommended them. We did research on the service and they seemed to get positive review and the fact we are ordering from New Zealand we do not have to pay VAT.
We ordered our EQ 4 Server on 16/09/2009 and it was provisioned on the same day.
We were billed on the 2nd week of October which was fine. In the 3rd week of October the server exceeded 2TB and therefore it was reduced to 10Mbit/s which is fine.
It's now November and we expected the server to return to 100Mbit/s as per the definition on their website stating the following:

Traffic Usage is for free. We will restrict the connection speed to 10 MBit/s if more than 2000 GB/month are exceeded. Optional, a permanent 100 MBit/s-bandwidth will be charged 14,90 € (incl. VAT) per additional TB.
Well of course my monthly bandwidth was reset to 0MB on November 1st and therefore we have not exceeded our usage for the month.
We emailed Hetzner Technicial Support with the following:

We received the following reply from Hetzner

This was not the response I expected, therefore I emailed their Technical Product Advice team with the following:

The Hetzner Robot states our usage is 10GB for the current month. Therefore it should not be throttled as we have not exceeded 2000 GB for the current month.
In turn I received the following response which was very unexpected response by Hetzner

I have read and screenshot all their terms and conditions and also system policies which does not state any where that I agreed to stay on 10mbps once going over the 2TB/month.
Since Hetzner Online AG operates out of Germany, And since Germany is a member state of the European Union. It is bound by the Consumer Protection Directives of the European Union.
My question is have I interprated what Hetzner are offering/selling incorrectly or they have mislead me?
If they have mislead me then some of following rights and responsibilities apply, these apply everywhere in the EU.

PHP 5.2.1 installed on WHM 10.8.0 cPanel 10.9.0-C9565
If I load a php file on browser, it gets loaded, but in HTML source I can see php code.
If I run in SSH "php info.php", the php code gets runn and normal output is generated.
I checked these lines in httpd.conf:

Godaddy provides some quick-install apps on Hosting manage page, I got WordPress installed and found the robots.txt file disallows any search engines, it reads:

Disallow: /

I just noticed that in our first zone, every record has a TTL of 900. All three nameservers in our system are handing out the same incorrect TTLs (easily visible via AXFR, and expected since two are slaves). Operations > Customers > Customer > Domains > domain shows every record in this zone has a TTL of 42300. The DNS resource's Activation Parameters and zone's SOA are set as follows:
Refresh 43200
Retry 600
Expire 2419200
Min TTL 900
Default TTL 43200 (for the resource; not editable for the zone)
PPA seems to be silently using the Min TTL to override the zone records that it shows with the desired TTL on screen. Changing the Min TTL in the SOA for a zone changes the TTL of all records.
This zone has both template-generated and manual records.

if anyone has a 10mb or larger testfile on a Hetzner.De server. We need a couple of new servers, for two unrelated projects. Looking at Hetzner.De it seems to be perfectly suited for our needs on one project, just wanting to see what the bandwidth is like coming through to Australia.

I have server from many providers, hetzner, sharktech & burst.
But the worse i found is of burst.net.
I have been with them since 2+ month now, but the quality of service am getting since i order has been not nice.
from the beginging server used to get crash after every 5-6 days then i need ask what happened, and they were never able to provide the reason.
i ignored it as reboot were within 15-30 minutes which is acceptable.
But since last 15 days. server has been crashing every 12-15 hours.
one of the technician said that its hard drive, (oh comeon hard drive has nothing to do with it. i will let you know later why.)
then i asked him to change the hard drive.
First they offered me data recovery package which costs some $$$.
I said ok just put os in new hard drive and attach my old hard drive so that i can take backup.
I asked them why. then they changed the whole machine with everything brand new. and attached my old hard drive
I took backup and after 2 hours its dead again(crashed ).
They never replied me within hour or so after that.
They blamed that old hard drive is causing crash.
alright i asked them to remove old hard drive and what happened? Still crashed and dead for 3 + days now.

Just make sure whenever you do business with anyone , they should be responsive and they should know what they doing.
My contract will expire on 9th of nov, but i guess my money is already wasted.

I have Hetzner server, this was my first time to reset the hardware and it won't boot, the OS is SUSE, I contacted the support and they have no software support and that i need to fix it my own.
I use their Rescue-system to access the server but i do not know where, what and how to fix the boot problem.
I remember when I mounted the 2nd harddisk, and in the Partition it ask something about boot and I answer Yes, I don't know if this might be the cause.

i and some other people were scammed under Hetzner servers. Please avoid hetzner. I found out its not the first time they were used by Scammers, and im sure it wont be the last.
Maybe you have some nice memories with hetzner, well i cant deny that, but wait until you get into a messy situation, you will see the true color of this company.
When I smell something not right about Hannes, I immediately seeked their assistance to move in my data to their server. But Hetzner, didnt care.
Someone told me, in a similar incident few months ago, they were scammed by some guys selling Hetnser colo. This person contacted Hetzner and Hetzner didnt care.
Its true. Hetzner didnt care. I contacted them so to get assistant to move my data into their servers. I told them I want to be their customer, but they simply told me to rent a server and move the data myself.
This is the true Hetzner!! It has been home of few or maybe dozens of Scammers. And time has proven itself, be careful of hetzner.
Some people will say, its not Hetzner's fault, but remember this its not the first time, hetzner's used by Scammers. In reality, if you keep a Scammer in your home and he scammed the society using ur name, in some countries, you can be liable too.
What Im saying is, avoid hetzner before you ended up in trouble, because then only you will see their true color. By then its too late.
Theres nothing much I can do now.. But you can... Avoid Hetzner.. But the choice is yours.

I am currently planning to move from my current provider to Hetzner.de, and wanted to synchronize this in a way that would avoid too much overlay, basically don't want to double pay for a whole month.
I asked hetzner.de support how long it takes to setup a root server, and their answer was "up to 3 weeks", and asking for the average did not help.
how long it usually takes to setup a server there? Isn't 3 weeks too long?

time to write few words about the providers I've been working with. I was with Hetzner for about a year (2007-ish). Initially I've been reluctant a bit to go with them because of a high setup fee, but after exploring other options I've decided to give them a shot.
For those interested, all my correspondance with them was in English.
Ordering process was easy and painless. Initially I'd ordered DS3000 server, and in less than 24 hours I got login credentials for it. Due to some last-minute business changes I have made some calculations and realized that DS5000 would have fitted my needs better, and I asked whether it's possible to "upgrade" my account to DS5000 before any work has been done on DS3000. They politely replied I should cancel my old order within 14 days and I'll be given a full refund on "no questions asked" policy stipulated by a german trade law, I suppose, which gives you right to cancel (within 2 weeks) any contract that has been arranged remotely.
Now that felt good. The only catch is that the cancellation letter had to be in writing, so I had to find a fax machine from which it could be sent to their billing dept.
In the meantime I have ordered a DS5000 and again received a fully provisioned box in less than 24 hours. Few days after I received my first invoice, stating 83.19 EUR setup fee and 49.58 monthly recurring fee. Huh? Only then I've realized that their stated prices include VAT which can't be billed to non-EU residents. Excellent!
Now, to the service provided. Over a year long period, I only had two downtimes: one planned and one uplanned. The unplanned one was a half-hour long network outage. The planned downtime was due to the power lines work in the datacenter my box was in. It had been announced 2 weeks in advance, and the downtime was about 2 hours.
It is worth noting that all automated emails I've received from Hetzner were bilingual (German/English).
I had nothing but praise for their services/price ratio. Their network is excellent, and the hardware is top-notch. Keep in mind that my bandwidth requirements were low, as I have never used more than 500 GB/month.
To summarize:
For: excellent hardware deal, network (for European users), remote reboot and network rescue system provided free of charge
Against: if you need more than 1 TB/month, you should look elsewhere. KVM/IP charged extra.

in a domain environment, how do I enable users to be able to access the Desktop properties and allow them to change their wallpapers. By default/ after some group policy changes, all users are denied from accesing this properties window.

I dont bash hosts often, because i realize some problems will come up that are out of the host's hands. Network downtime, hardware failure, etc.
Most ive been with, have been very understanding, and willing and ready to remedy the situation by compromise on both the customer, and hosts sides.
I decided to switch my forum to a VPS and decided to go with ZONE.net. They seemed reasonably priced, and ive seen some good reviews here on WHT.
So, this past Saturday evening, I signed up and get the first few payment confirmation emails.
Monday morning, I get an email from my current shared host, that I would not qualify for a refund for that month since it was past the 30 day money back guarantee. I had been with them for 3 months. I had 2 weeks to go so I said ok, it seemed fair.
I email zone.net on Monday to cancel the VPS since it hadn't even been provisioned yet.
Tuesday morning, I wake up to account info from zone.net
I shoot back in email asking why it hadn't been canceled since i would be staying with my host a little longer. I asked them to cancel, and issue a refund.
They quickly point me to their TOS and state they dont issue refunds for any reason. I would be inclined to agree, but certainly these are special circumstances. I asked to cancel my VPS BEFORE it was even created.
I shoot back an email saying that I would be willing to settle a refund, minus the costs of the control panel license, which is the only thing they are out anyway. I have not even logged in to the account. This was all Tuesday morning. I have not heard back from them yet. They are probably ignoring me.
I will not email them anymore, I will not even ask for the refund back anymore.
So, be warned. If you decide to get a VPS with zone.net, MAKE SURE THERE ARE NO HICCUPS, and BE SURE YOU WILL NOT CHANGE YOUR MIND AFTER HITTING THE SUBMIT BUTTON. Oh and expect 48hrs+ of setup time on something other hosts do in 3hrs or less.
If they need to hold on to a customer's money like this, they obviously need it more than me to keep their so called business afloat.

Virpus don't respect own policy..
14 days moneyback is not true. virpus don't refund at all.
servers are overloaded. very slowly and if you ask for moneyback he. just don't answer you
i have buy signature vps with them and on 10 days.
servers have 1 downtime every day. and sometime (2 days) you cannot log into servers or view page because is overloaded.
when your servers back online. its take aproximatly 30 seconde before " website or panel " load.
just think before purshase. virpus network scam her client and don't respect own moneyback policy.
now i wait paypal issue.

I'm trying to establish a policy for hosting requirements.
I keep running into this recurring problem where a company hosts their own site or they want to host with a business associate or friend that has some kind of side business.
This often results in:
• Drastic responsiveness issues
• Half @ss server setup
• No back up mechanisms
• Non-standard setups
I'm thinking of bumping the price on all my quotes by 20% and offering a 20% discount if recommended hosts are used. Another alternative which I would prefer is just to refuse to work on any other, but I don't think I could get away with that.

I don't know anything about CPU. According to BlueHost, they offer 40 seconds of CPU processing within a 60 second period. Our sites are mainly forums and blogs. For the next year, at most, we'll have 200 unique users a day, we're guessing. Do you think running something like WordPress or forum software would be too much with BlueHost's restrictions? We will focus on 10 sites during this time, so it'll be about 2,000 unique visitors a day across our entire account.

I recently got a Windows VPS from 1and1 internet. I tried to run Windows update and Baseline Analyzer (SOP for me)..but neither would work. I learned that it seems to be Sw-Soft that have taken it upon themselves to test and push Windows updates to the hosts. Is this just for the big boys like 1and1? Or is this something Sw-soft does for all hosts?
Just wondering..say what you want about 1and1..I must say my experiences have improved over the last few weeks..and it does seem like they are really trying harder.

Seems like my IP is blocked by comcast and clear channel. Comcast sucks and do not respond. They have the worst customer service ever. Clear channel is just another monster corporation as well with no concern.

I have no idea WHO fecheadorar.com is, but it is not/nor ever was hoste on my box.
How would I resolve this? There is absolutely no contact info on their site.

I spent 6 months trying to get DotNetNuke up and running. Servergrid web hosting puts way too many sites on the same server. My site would sometimes take over 5 minutes to load. Often it would not load at all. I cancelled my subscription with them and two months later I have still not received my refund.

do they then directly take over or something? how does it work? how do i get support for the server? when i buy from a reseller do i need to approach him for support or directly burstnet?
also if i buy from a reseller can i still get direct support from burstNet irrespective of the reseller being or not being in b business?

my email address is being spoof/forge. i have added spf record into the DNS for couple days now but i'm still getting rejected/bounced email. is this correct or is spammer is still able to forge my email and sending out spam?
edit: where can i check if my domain/server is on spam block list? since dnsstuff's tool cost money.
